These Terms and Conditions govern your use of the services provided by Hitech Service, a GST-registered IT services proprietorship based in Mumbai and owned by Ankit Rajesh Dalal. By engaging our services, you agree to be bound by these terms.
1. Introduction
These terms apply to all projects, engagements, communications, proposals, and deliverables provided by Hitech Service unless otherwise agreed in writing.
2. Services
Hitech Service provides professional IT and digital services, including but not limited to:
- Web development and website maintenance
- Digital marketing and online growth support
- IT consulting and technical advisory services
Specific deliverables, timelines, and scope will be defined in the applicable proposal, estimate, work order, or agreement.
3. Payment Terms
Payment schedules, milestones, and due dates will be communicated in advance and may vary by project. Unless otherwise stated, invoices are payable according to the terms listed on the invoice or agreement.
All applicable charges are subject to GST. Hitech Service is GST-registered under GSTIN: 09AFOPD9131J1Z4, and invoices will reflect applicable taxes in accordance with Indian law.
Any delay in payment may result in suspension of services until outstanding amounts are cleared. Any banking fees, payment gateway charges, or similar transaction costs, if applicable, may be borne by the client.
4. Intellectual Property
Unless otherwise agreed in writing, Hitech Service retains ownership of its pre-existing tools, frameworks, methods, code libraries, templates, and internal materials used in the course of providing services.
Upon full payment, the client will own the final deliverables specifically created for the client, excluding any third-party materials, open-source components, or Hitech Service pre-existing materials incorporated into the work.
The client remains responsible for ensuring that any content, trademarks, images, data, or materials provided to Hitech Service do not infringe third-party rights.
5. Confidentiality
Both parties agree to keep confidential any non-public business, technical, financial, operational, or customer information received in connection with the services.
Confidential information will not be disclosed to third parties except where required for performance of the services, with prior authorization, or as required by law.
6. Limitation of Liability
Hitech Service will perform services with reasonable skill and care. However, to the maximum extent permitted by law, Hitech Service shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
Our total liability for any claim arising out of or relating to the services shall not exceed the amount actually paid by the client for the specific services giving rise to the claim.
7. Termination
Either party may terminate a project or agreement by providing written notice, subject to any notice period or cancellation terms stated in the relevant proposal or contract.
Upon termination, the client remains responsible for payment of all completed work, approved expenses, and any amounts due for work already performed up to the effective termination date.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Mumbai, Maharashtra, India. Any disputes arising under these terms shall be subject to the jurisdiction of the courts in Mumbai, Maharashtra, India.
